Jay has experience in a broad range of litigation and appellate matters. As an attorney in South Florida, Jay litigated general and complex matters before state and federal courts on behalf of clients ranging from Fortune 500 companies to emerging technology companies, and from governmental entities to individuals. Jay's litigation experience includes employment litigation, business and commercial litigation, including collections for publicly traded companies, and civil rights litigation under the Americans with Disabilities Act, Fair Housing Act, Fair Labor Standards Act, Age Discrimination in Employment Act and Family Medical Leave Act, including both the defense and prosecution of 42 U.S.C. § 1983 claims.
As a litigator, Jay was responsible for obtaining summary judgment in federal court for his client in a dispute regarding a $36 million mixed use redevelopment project approved by the City of Delray Beach, Florida and challenged by landowners adjacent to the proposed development (see reported decision below).
In the appellate arena, Jay has drafted and submitted briefs and petitions to the state appellate courts in Florida, the United States Eleventh Circuit Court of Appeals, and the Supreme ` Court of the United States. In 2000, Jay obtained an order granting summary judgment to his client in the United States District Court, Southern District of Florida, in a complex Americans with Disabilities Act/Fair Housing Act civil rights claim. Upon appeal, Jay successfully obtained an affirmance of the order, after presenting oral argument to a three-judge panel of the United States Eleventh Circuit Court of Appeals.
Jay lives in Oakland with his fiancée, an associate in an education law firm located in Walnut Creek, California. Jay's interests include music, photography and the outdoors.
